PANA Pickleball Waiver, Release and Media Consent

In consideration for being allowed to take part in any event, clinic, league, tournament, social or other activity organized by PANA LLC d/b/a Pana Pickleball (each an "Event"), I agree as follows. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM WAIVING IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE.

1. Released Parties

"Released Parties" means PANA LLC d/b/a Pana Pickleball and its owners, members, managers, organizers, staff and volunteers, and the owners and operators of any venue hosting an Event (including Saddlebrook Resort, Mouratoglou Academy and Ace Pickleball Club), together with their employees and agents.

2. Assumption of risk

I understand that pickleball involves inherent risks, including but not limited to falls, collisions, being struck by a ball or paddle, physical exertion, heat, court conditions, weather, and the actions or negligence of others.

I knowingly and voluntarily assume all risks, known or unknown, including risks arising from the negligence of the Released Parties.

3. Release of liability, including negligence

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, I RELEASE, WAIVE, AND AGREE NOT TO SUE THE RELEASED PARTIES FOR ANY INJURY, DEATH, OR DAMAGE ARISING OUT OF OR RELATED TO MY PARTICIPATION IN ANY EVENT, INCLUDING CLAIMS CAUSED BY THE NEGLIGENCE (ACTIVE OR PASSIVE) OF THE RELEASED PARTIES.

4. Indemnification and hold harmless

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from any claims, damages, and expenses (including attorneys' fees) arising out of my participation in any Event, my actions or negligence related to that participation, or any injury or damage I cause related to that participation.

5. Medical and fitness

I certify that I am physically able to participate and I assume all health-related risks. I authorize emergency medical care if I need it and accept full financial responsibility for that care.

6. Rules and conduct

I agree to follow the rules given by the Event organizers. I understand that I may be removed from an Event for not following those rules, or for unsafe or inappropriate behavior, at the sole discretion of the Event organizers.

7. Media release

I give permission for photos, video and other recordings of me taken at any Event, and my name, image and likeness, to be used for promotional purposes by the Released Parties or any third party they authorize, without payment to me.

8. Florida law and jury waiver

This Agreement is governed by Florida law. Any dispute shall be brought in Pasco County, Florida. Before litigation, any dispute must first go to mediation, held in person at the sole cost of the party asserting the dispute or claim.

I WAIVE ANY RIGHT TO A JURY TRIAL in any claim related to this Agreement.

9. General terms

This Agreement covers every Event I take part in and is intended to be as broad as permitted by Florida law. If any provision is found invalid, the rest of the Agreement remains in full force and effect.

I am 18 years of age or older. I HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND SIGN IT FREELY AND VOLUNTARILY.
